Welcome to bidzone.sg. Vibrant eZone Pte. Ltd. (“the Company”) [Business Registration No.:201025050E] has exclusive rights to www.bidzone.sg and the business of bidzone.sg.

To participate in any of the online auctions at bidzone.sg, you need to be a registered member of bidzone.sg and be at least 18 years of age. Before you proceed with the registration, you must read through carefully and accept all the Terms and Conditions of this User Agreement. The User Agreement constitutes a legally binding agreement between you and the Company. Please print or save a local copy of the Terms and Conditions for your records.

Terms and Conditions

The following terms and conditions shall govern the relationship between bidzone.sg and bidzone.sg users (“Members”).

Please note that words importing the singular number shall include the plural and vice versa, and words importing any particular gender shall include all other genders.

1. GENERAL

1.1 Members are users who register with bidzone.sg. Members agree to abide by these Terms and Conditions published on bidzone.sg website at www.bidzone.sg. The Company reserves the right to revise or amend these Terms and Conditions. By registering with bidzone.sg, the Member consents to be bound by these Terms and Conditions including all alterations and variations and the manner in which bidzone.sg operates. All Members are subject to these Terms and Conditions, Rules and Policies at the time they successfully bid for any article published on bidzone.sg website.

1.2 The Company shall not be liable for any advice or materials posted on bidzone.sg which are at all times suggestions only. All content on bidzone.sg website is not intended to amount to advice on which reliance should be placed. The Company disclaims to the fullest extent permitted by law all and any liability and responsibility arising from any reliance placed on such materials by any visitors or any other sources to bidzone.sg website or by anyone who may be informed of any of its contents.

1.3 The Company, its agents, third party content providers, suppliers and licensors do not warrant that this site, information, content, materials, products (including software) or services included on or otherwise made available to you through this site; their servers; or email sent from bidzone.sg are free of errors, viruses or other harmful contents. In addition, the Company does not represent or warrant that the information accessible via the site is accurate, complete or current.

1.4 Employees (and their immediate families) of the Company and each of their advertising agencies are not eligible to register withbidzone.sg.

1.5 Each household is only allowed to open one account. Additional accounts will be deleted and tokens and auctions won will be forfeited.

2. PURCHASE OF TOKENS

2.1 The Member must purchase tokens in order to bid in an online auction. Tokens shall be purchased in packages (bid packages) and payment shall be by PayPal only. Payment must be made in full before it can be honoured and only after which a bid may be placed. The Company reserves the right to charge a returned payment fee for any payment which is not honoured.

2.2 All tokens purchased are NON-Refundable and NON-Transferrable.

2.3 The Company reserves the right to block any Member whose outstanding fees are not settled.

2.4 By placing a bid on bidzone.sg, the Member confirms that he is at least 18 years old.

2.5 All types of tokens and coupons (including “tokens purchased in packages”, “free tokens” and “redeem coupons”) have an expiry date. There will be no refund and no extension for expired tokens and coupons.

2.5.1 Tokens Purchased

Tokens purchased are valid for 180 days from the time the tokens are credited to the Member’s user account.

2.5.2 Free Tokens

Free tokens are valid for 180 days from the time the tokens are credited to the Member’s user account.

2.5.3 Redeem Coupons

Redeem Coupons are valid for the period as stated at the time of issue.

2.6 Once a bid is placed in an auction, a token is deducted from the Member’s user account and will not be refunded. There will also be no refund for any excess tokens used during the bidding process.

2.7 Won Token Package

Tokens won from auction shall only be credited into Member's user account within 24 hours upon full payment of the won auction.

3. BIDDING PROCESS

3.1 The Member is required to bid for auctioned articles against other bidzone.sg members.

3.2 The Company reserves the right to add, reschedule or remove articles for auctions from bidzone.sg website at anytime at its absolute discretion without notice.

3.3 Members may place a bid in one of the following ways at a time:

3.3.1 Manual Bidding

Click on the BID!button. A token will be deducted from the Member’s user account for each bid made.

3.3.2 Automatic Bidding

Activate the Bid Butlers. The Member can activate the Bid Butlers to bid on his behalf. Once activated, the Bid Butlers will stay active even when the Member has logged off from his computer. To activate Bid Butlers, the Member must set the specifications for the bids in advance and Bid Butlers will place the bids following the specifications. (Details could be found at “HowItWorks”on bidzone.sg website.) For each bid made by the Bid Butler, a token will be deducted from the Member user’s account.

3.4 When the Member places a bid, he is deemed to be willing to enter a binding contract with the Company. A contract to buy the auctioned article will automatically come into effect once the last bidder has executed the steps stated in “WON AUCTION” in paragraph 4.

3.5 The price of the article being auctioned will increase, corresponding to the amount of bids placed.

3.6 Each new bid resets the remaining time for an auction which shall not exceed the countdown reset value. The auction ends when the time reaches zero. The Member who successfully activated the last bid wins the auction. All other bids placed on the article are then expired and will not be credited to the bidders’ account nor refunded. The Company’s decision on who the last bidder is shall be final.

3.7 The Member is solely responsible for his own bidding process which includes his internet connection, compatibility of software and any other technology-related elements. The Member shall not hold the Company liable for any claims, causes of action, expenses, costs or losses arising from or related to any transaction in which his bid is not received, delayed or otherwise rejected by bidzone.sg.

3.8 The Company reserves the right at its absolute discretion to limit the number of auctions the Member can win within a specific time period. Each member is currently limited to a maximum of 8 won auctions within a 28-day period.

3.9 Some auctions may offer the “Buy Now” option. The Member may purchase the article within a specified time by clicking on the “Buy Now” button. In doing so, the Member may no longer participate in that particular auction and agrees to buy the article at his unique buying price. This buying price is based on the number of bids (excluding free bids) placed by the Member for that article. The Member must make payment for the article within seven (7) days. Otherwise, the Member is deemed to have withdrawn from the transaction and the bids used will not be credited to the Member’s account nor refunded.

4. WON AUCTION

4.1 The Member who successfully activated the last bid wins the auction. When the auction ends, the winning Member proceeds to “My Page”, clicks on the “Confirm” button and the win is accepted.

4.2 The Member must confirm and make payment for the won article, with the exception of Token Package article, within seven (7) days of the auction end date. Otherwise, the Member is deemed to have withdrawn from the transaction and forfeiting the article. All bids used for that article will not be credited to the Member’s account nor refunded.

4.3 The Member must confirm and make payment for the won Token Package article within six (6) hours of the auction end date. Otherwise, the Member is deemed to have withdrawn from the transaction and forfeiting the article. The Company reserves the right to investigate and where necessary suspend the Member for a period of time if the Member is deemed to bid for the Token Package article without the intention to purchase it.

5. DELIVERY

5.1 The Company is committed to deliver the articles within Singapore only.

5.2 The Member is responsible to inspect the article before signing and accepting it from the courier. Do not sign for it if the article is damaged or incorrect.

5.3 All articles are new and sold with the manufacturer’s limited warranty. The Company shall not be liable for any defects or technical faults of the articles.

5.4 All requests for technical support and services should be made directly to the manufacturer subject to their terms and conditions. The Company shall not be liable for any personal injury or damage to property resulting from improper handling, modification, or misuse of the article after delivery. The Company shall not be liable to any person for incidental or consequential damages including but not limited to loss of profits, goodwill, loss of use, expenses incurred.

5.5 In the event that the article won is not available in the market for whatever reason, the Company reserves the right to substitute the article with an article of the same value.

6. SYSTEM FAILURE

6.1 The Company is committed to ensure that the system properly functions at all times. As in all software and hardware, there is no guarantee that the system will function without any failure or fault. The Company shall endeavor to do its best to expeditiously resolve any system failure or disruption.

6.2 The Company reserves the right to permanently stop bidding of articles when the system fails. The bids placed may be refunded to the Members’ accounts for biddings which are permanently stopped due to system failure or disruption.

6.3 The Company shall not be liable for any loss or damage arising in the connection with the bidding process, including without limitation, any computer system or equipment breakdown, electronic malfunction or any notice which is misdirected or lost in the post.

6.4 Should the Company suspect an unlawful action(s) brought bidzone.sg down, the Company reserves the right to investigate the matter and, where necessary take legal action against the perpetrator(s).

7. INTELLECTUAL PROPERTY RIGHTS

7.1 All content included in bidzone.sg is the property of the Company or its third party suppliers/licensors. Any unauthorized print, copy or download of any part of our website will immediately cease your right to use website. The Company further reserves the right to take legal action against you.

8. APPLICABLE LAWS

These Terms and Conditions shall be governed under the laws of Singapore.

9. PROTECTION OF DATA

The Company shall protect the privacy and confidentiality of Member’s data.

10. MISCELLANEOUS

10.1 These Terms and Conditions and Rules by the Company form the entire agreement of the Parties and shall supersede all prior written or oral agreement.

10.2 This User Agreement is binding on the Parties, their respective successors and assigns. The Member may not transfer, assign, charge or otherwise dispose of any agreement formed under these Terms and Conditions without the Company’s written consent.

10.3 No waiver by either Party of any breach or default hereunder shall be deemed to be a waiver of any other breach or default.

10.4 The section headings are for convenience only and shall have no legal importance.

10.5 The Company reserves the right to disclose and publish the name of any other particulars of the winner (including photographs) for publicity purposes and the winner agrees to cooperate with and participate in the activities organized by the Company for these purposes.

11. AMENDMENT

11.1 The Company reserves the right to vary, delete or add to these terms and conditions at any time at its absolute discretion without notice or liability to the participants of the bidzone.sg website or any other person.
